Appealing to Top Court Is High Risk Bet for Brazil Govt: FGV/SP

(Bloomberg) -- Political cost of suffering a defeat in appeal to Supreme Court is high for the govt because it would lend legitimacy to impeachment process, says Oscar Vilhena, director of FGV Law School in Sao Paulo.
  • Supreme Court unlikely to rule on merits of the impeachment, given the precedent of Fernando Collor’s case and signals given by some of the justices, said Vilhena
  • NOTE: Government Requests Supreme Court to Annul Impeachment
  • Another possibility of an appeal to the Supreme Court would be questioning procedures such as the order set for lower house floor vote
  • In that case, Supreme Court could eventually order to correct procedure, as it did when it set guidelines to form impeachment committee in lower house
